The Town of Fairview encourages residents to enjoy bicycles and other low-powered vehicles responsibly. Different types of electric vehicles are regulated differently under Texas law. Understanding which category your vehicle falls into helps keep everyone safe and avoids violations.
Electric Bicycles (E-Bikes)
An electric bicycle (e-bike) is a bicycle with:
- Fully operable pedals
- An electric motor of less than 750 watts
- A top assisted speed of 28 mph or less
Texas recognizes three classes of electric bicycles:

| Class 2 | Throttle and/or pedal assist | 20 mph |
| Class 3 | Pedal assist only | Less than 28 mph |
Class 3 electric bicycles must be equipped with a speedometer by the manufacturer.
Motor-Assisted Scooters (Electric Scooters)
Texas law defines a motor-assisted scooter as a self-propelled device designed to be stood or sat upon that meets the statutory definition.
Generally, motor-assisted scooters may:
- Be operated on streets with a posted speed limit of 35 mph or less
- Be operated on sidewalks unless prohibited by local ordinance
- Riders must yield to pedestrians when operating on sidewalks.
Pocket Bikes & Mini Motorbikes
Pocket bikes and mini motorbikes are not electric bicycles and are not motor-assisted scooters.
These vehicles:
- Are not designed for highway use
- Cannot be titled for highway use in Texas
- May not be operated on public streets, highways, sidewalks, or bicycle paths.

Are electric bicycles legal in Fairview?
Yes. Electric bicycles that meet the Texas statutory definition (Class 1, 2, or 3) are legal to operate subject to the Texas Transportation Code and any applicable local restrictions.
Do I need a driver’s license to ride an e-bike?
Texas law does not require a driver’s license solely to operate a Class 1, 2, or 3 electric bicycle.
Can children ride an electric bicycle?
Yes, with one important exception.
A person must be at least 15 years old to operate a Class 3 electric bicycle. A child younger than 15 may ride as a passenger on a Class 3 e-bike if the bicycle is designed for passengers.
Do I have to pedal an electric bicycle?
It depends on the class.
- Class 1: Yes.
- Class 2: No. A throttle may propel the bicycle without pedaling.
- Class 3: Yes.
Can I modify my e-bike to go faster?
If the motor-powered speed capability or engagement is changed, Texas law requires the bicycle’s classification label to be updated to accurately reflect the modification. A modified bicycle that no longer meets the statutory definition of an electric bicycle may be regulated differently under Texas law.
Can I ride an electric scooter on the sidewalk?
Generally, yes.
Texas law allows operation on sidewalks unless prohibited by a local ordinance. Riders must yield the right-of-way to pedestrians and give an audible warning before passing when necessary.
Can I ride an electric scooter on any street?
No.
Motor-assisted scooters may only be operated on roads with a posted speed limit of 35 mph or less, unless another law applies.
Are pocket bikes or mini motorbikes street legal?
No.
Texas law does not authorize operation of pocket bikes or mini motorbikes on:
- Public streets
- Highways
- Sidewalks
- Bicycle paths
These vehicles are generally intended for use on private property where permitted.
Are helmets required?
Texas does not have a statewide helmet requirement specifically for operators of electric bicycles or motor-assisted scooters. However, the Fairview Police Department strongly recommends that all riders wear a properly fitted helmet every time they ride and if possible a DOT certified helmet to ensure safety if a rider takes a fall at speed.
Are lights required at night?
Yes.
When operated at night, bicycles including electric bicycles must be equipped with:
- A white front lamp visible from at least 500 feet.
- A red rear reflector visible from 50 to 300 feet when illuminated by vehicle headlights, or a red rear lamp visible from 500 feet.
Does Fairview have additional local regulations?
At this time, the Town of Fairview has not adopted a separate ordinance specifically regulating electric bicycles, motor-assisted scooters, or pocket bikes beyond applicable Texas law. Riders should still obey all posted signs and restrictions in Town parks, trails, and other public facilities.

The Fairview Police Department encourages everyone to:
- Obey all traffic signs and signals.
- Ride in the same direction as traffic.
- Yield to pedestrians.
- Stay alert and avoid distractions.
- Wear a properly fitted helmet. (DOT CERTIFIED HIGHLY RECOMMENDED)
- Use lights and reflective equipment when riding after dark.
- Be courteous to other roadway and trail users.
